UPDF Soldier Sentenced To 10 Years for Defilement

The 2nd Division Court Martial in Makenke, Mbarara, presided over by Col. Geoffrey Mujuni Rwamunyonyore, today sentenced Pte Yusuf Kuyugano alias Bogoya to 10 years imprisonment for defiling an underage girl.

The convict was charged with aggravated defilement, being that he was HIV positive and intentionally passed it to his victim

Prosecution led by Lt. Marvin Busulwa told court that Pte. Kuyugano on 11 March 2015 had unlawful carnal knowledge with a 14year old girl in one of the inputs around Makenke barracks.

Court also heard that efforts to rehabilitate the victim have been futile since she was an orphan staying with an aunt in the barracks and has no chance of school, which forced her into prostitution.

Lt. Busulwa asked court to give a long sentence to the accused to keep him away from young girls.

Defense on the other hand however, pleaded for a lenient sentence on grounds that the defendant was a first time offender and a family bread winner.

Basing on Section 129(3) & (4&, B) of the penal code, Court Chairman Col. Geoffrey Mujuni sentenced the defiler to 10 years imprisonment.

Col. Mujuni stated that cases of UPDF officers abusing young girls ought to be completely eliminated.

Meanwhile, the same court sentenced another soldier Pte Edwin Namanya, 29, from Bushenyi district to 2 years imprisonment for deserting from the army since 2008 after being permitted for only 7 days to go for home duties.

The 2nd division spokesperson Maj. Peter Mugisa noted that this was a deterrent measure of equipping the army with good behaviors and punishing those intending to commit the same crimes.
