Jailed Makerere University researcher Dr Stella, who is charged with offensive communication and cyber harassment has informed Buganda road grade one magistrate Gladys Kamasanyu that she has opted to use newspaper adverts as one of the means to mobilize her defense witnesses.
“We propose a month to conduct an exercise of publishing a notice in the newspapers seeking for voluntary witnesses to testify in the prisoner’s favor” submitted defense counsel Ssemakadde
This he said is one of the few remaining options since court failed to compel some of their defense witnesses like Mustapha Mugisa to turn up for court.
“The prisoner and her counsel have no alternative but to seek an adjournment to enable us identify, approach and solicit resources that will enable us present willing and voluntary witnesses”
The defense also faulted the trial magistrate for refusing to provide them with certified copies of record of proceedings for this matter as earlier requested by some of the lined up defense witnesses.
The state prosecutor Timothy Amerit described the request by the defense counsels as delay tactics which are aimed at prolonging this case which has become part of Judiciary’s backlog.
“The act of advertising witnesses in various media outlets as requested by the defense its unprecedented practice and alien in our legal practice” Amerit added
He thus asked the Magistrate to compel the defense if they don’t have witnesses to close their case.
The magistrate has set Monday next week as the date on which she will give her ruling about the matter.
