Mustapha Mugisa, who meant to be one of the first defense witnesses in the case in which Dr Stella Nyanzi is accused of “disturbing the peace of the president,” today failed to testify before court.
Mustapha, an ICT expert told the trial magistrate Gladys Kamasanyu that he couldn’t testify because he was not conversant with the case.
He added that he couldn’t testify in a matter where he has not been briefed
Defense lawyer Isaac Ssemakadde said he was surprised to see a public servant failing to help court in its duty.
The magistrate warned the defense against delaying the trial and ordered them to produce well prepared witness tomorrow.
Kamasanyu added that it’s the defense’s role to prepare their witnesses instead of hoping that the prosecution will do it for them.
The matter has been adjourned to tomorrow for further hearing
Court recently declined to summon President Museveni as one of the defense witnesses in this case because the constitution protects him from appearing in court during his tenure in office
Among the remaining witnesses expected in this matter include the Director of CID AIGP Grace Akullo
Dr Stella Nyanzi who is currently on remand at Luzira Prison is charged with offensive communication and cyber harassment.
