State Tasked To Amend Charge Sheet In Magistrate Assault Case

Buganda road grade one Magistrate Stella Amabirisi has ordered State Prosecutor Mariam Njuki to present to court an amended charge sheet on which six people are accused of assaulting Magistrate Kamasanyu with a water bottle

This followed complaints by defence counsel Isaac Ssemakadde who argued in court that it was unlawful to charge his clients on a defective charge sheet.

Ssemakadde, in his submissions said it was improper for the state to accuse his clients of inciting violence without pointing out any means in which it was done; and that the same charge sheet has a duplicity of offences

“You can’t accuse Fatuma with other people of throwing a single bottle,” he argued.

The Magistrate adjourned the matter to Friday 8th November to enable the prosecution present in court an amended charge sheet on the matter

All the accused who include Augustine Ojobire, Waiswa Abdullah, Joel Kabali, Katumba Moses, Simon Wanyera and Zainah Abenabyo were present in court today.

Its alleged   that on 2nd August this year at Buganda Road Court, the six accused persons incited court audience to do an act of violence to Magistrate Gladys Kamasanyu.

Abalinayo Fatuma Zaina, one of the accused is charged with common assault, as state alleges that she and others still  at large assaulted her worship Gladys Kamasanyu while in court
