Nyanzi Lists President Museveni, AIGP Akullo As Key Witnesses

Jailed former Makerere University Researcher Dr Stella Nyanzi yesterday stunned Buganda road magistrates court, when she named among others President Yoweri Museveni as her witness.

Nyanzi is facing “offensive communication” charges for her alleged attack on the family of the president last year.

The trial magistrate Gladys Kamasanyu last week ruled that Nyanzi has a prima facie case, and adjourned the matter to Wednesday for the defence hearing.

Through her lawyer Isaac Ssemakadde, Nyanzi made an application asking court to assist her in summoning more than 15 witnesses she intends to rely on throughout her defence.

“The Prisoner in the due process is silent and has asked court to help her summon the witnesses” counsel Semakadde submitted

Among the witnesses she wants summoned is President Yoweri Museveni, Director CIID AIGP Grace Akullo, Bishop Zac Niringiriye, Rev Fr Gaetano Batanyenda, Prof Sylivia Tamale, Professor Frederick Juuko and others including Minors whose names have not been revealed to court

Ssemakadde asked court to prioritize Associate professor Kakungulu, Eng. Frank Katumba and President Yoweri Museveni as the first witnesses in the matter

On being asked on the nature of defense the accused intends to use, Nyanzi through her lawyers has opted to keep silence.

” By virtue of article 110 b of the Magistrates Court Act, I reserve my comment and pray that court doesn’t make any further comments,”  Ssemakadde prayed.

This application however, was strongly objected to by the state prosecutor Timothy Amerit who asked court not to make any further step before Nyanzi informs court the means through which she intends to use in defending herself.

“Prosecution is concerned that the due process of the law is followed. It should not be bent basing on somebody’s stature”

The magistrate adjourned the matter to 1st July 2019 when she will deliver her ruling on whether the Nyanzi can proceed with defence before clarifying on the method she intends to use.
