High Court commercial Division judge Henry Peter Adonyo has set the new date on which he will deliver a ruling in an application where Ham Enterprises asked court to dismiss the defense filed by Diamond Trust Bank (DTB).
In the main case , Ham accuses DTB Uganda and DTB Kenya of siphoning over 120 billion shillings from his account without his knowledge.
The bank on the other hand says it owes the businessman money arising from the loans it had offered to his company.
Earlier on, the judge had fixed the ruling for today (Monday) in the morning hours.
However, Adonyo said today that the ruling was not ready and thus fixed Wednesday 7th October 2020 as the date on which this decision will be delivered.
Among others, Ham Enterprises wants DTB’s defense struck off record on grounds that the loan is based on illegal transactions since the Bank which is said to have lent the money has no license to operate in Uganda.
He adds that DTB Uganda was used as an agent to demand money for DTB Kenya which raises many questions.
Last week court suspended the independent audit exercise to both Ham Enterprises and DTB accounts so as to established the loan due by both parties.
