Masindi Resident Judge Justice Rugadya Atwooki has slapped costs against Prudence Alituha the principal fisheries officer for withdrawing the case she had filed against Masindi district local government and the chief administrative officer, John Nyakahuma.
In November 2018, Alituha dragged Masindi district Chief Administrative Officer, John Nyakahuma and Masindi district local government accusing them of prematurely terminating her term of office as the acting District production and marketing officer.
At the same time she applied for an interim order seeking court to stop the handover of office of the district production office and marketing to Dr. Fred Ssebuguzi the district veterinary officer which the Assistant registrar dismissed with costs.
Simon Kasanki from Kasangaki and company Advocates the lawyer representing Masindi district local Government and John Nyakahuma the CAO told court that Alituha prudence applied for the withdraw of the main suit on the 5th of December 2018 and the Assistant registrar accepted the request and adjourned the matter to today in the presence of Alituha and her lawyer.
Kasangaki told court that if the application was to be withdrawn it should be withdrawn with costs. However Justice Rugaya said the matter could not be heard because Alituha Prudence and her lawyer Susan Zemei were not in court which forced the judge to first halt the matter and wait for Alituha and her lawyer.
After Alituha and her lawyer failed to show up, Kasangaki’s urgument was heard after he told court that Alituha’s lawyer Susan Zemei was cited around court premises.
Kasangaki asked court to dismiss Alituha’s application with cost saying that the applicant filed an interim order and it was dismissed by the Assistant registrar Simon Kintu Zirintusa saying that the same application had been born by the main application.
Rugadya accepted Kasangaki’s request and granted the costs. Addressing journalists at court premises, Kasangaki said they are going to sit and calculate such that they can come out with the actual figure.
