Mengo Chief Magistrates Court has fixed 9th December as the hearing date for the case in which Hassan Male Mabirizi wants court to compel the National Identification and Registration Authority (NIRA) to serve him with the certified forms which were used by Hon Robert Kyagulanyi Sentamu while applying for his National identity card
Mabirizi petitioned NIRA seeking this information with a plan to use it in prosecuting Kyagulanyi on charges relating to giving false information to various authorities regarding his date of birth and academic qualifications.
In response to Mabirizi’s request, Brig Stephen Kwirigira the Acting Executive Director NIRA said the lawyer had not fulfilled all the requirements to be allowed access to this information.
Among the legal requirements, the NIRA ED said Mabirizi need to pay the prescribed fees, get Bobi Wine’s consent or secure a court order.
“This is therefore to request you to comply with the above mentioned requirements to enable us respond appropriately.”
However, Mabirizi claims that despite fulfilling the legal requirements set up in law, NIRA denied him access to the said documents.
In the suit before court, he seeks an injection restraining NIRA from concealing information pertaining the certified copies which Kyagulanyi used in applying for his National I.D.
He further claims that the information which he requested for is liable to disclosure in public interest to enable him institute Criminal proceedings
He further informed court that it’s in the interest of promoting administrative fairness, efficiency, transparency and accountability among political leaders and statutory bodies that this application is granted.
