Lawyers from Credo Advocates have written to the Inspector General of Police Martin Okoth Ochola, asking him to order all senior officers whose contracts have expired to vacate office within two days after receiving their letter.
The officers with expired contracts reportedly include AIGP Stephen Kasiima (Director Traffic), Balimwoyo Moses the head of Interpol Uganda, AIGP Lemmy Twinomugisha Director in charge of welfare and production, AIGP Joseph Mugisa the head of Fire and Rescue Directorate in Uganda Police and AIGP Asuman Mugyenyi the Director in charge of operations.
In their letter, a copy of which was received by the IGG on 14th January 2020, the lawyers argue that the five listed officers have no mandate in law to execute duties purportedly on behalf of Uganda Police or Government of Uganda after their contract expiring without any renewal or extension from the appointing authority
“Should you decline to implement our demands herein, we shall be constrained to sue you in your personal capacity with the result that court orders you to pay all the monies that the impugned individuals would have from the government in a period they illegally occupied office.”
The lawyers advised the IGP that as he awaits the renewal for these senior officer’s contracts, their deputies can in the meantime take over offices until further notice
“By allowing someone to occupy a government office without any form of contract, you are actually promoting mal administration impunity and tendency of lack of accountability. This is punishable by law.”
This development comes days after the Minister of Internal Affairs Gen Jeje Odongo wrote to the IGP asking him to allow the affected officers to remain in office until the determination of the appointing authority.
Last month, High Court judge Henrietta Wolayo ordered AIGP Godfrey Bangirana, a Police Director in charge of Engineering to vacate office until the matter in which he is accused of illegal stay in office after the expiry of his contract is fully heard and disposed of by court.
