The Commission of Inquiry into Land Matters has summoned city businessman Drake Lubega to defend himself on allegations that he illegally acquired the land housing Qualicel Bus Terminal in downtown Kampala on which he is setting up structures.
This came after Mr Hamimu Sentongo, the Chairperson of Uganda Bus Operators Association Investments (UBOI), on Monday appeared before the land probe led by Justice Catherine Bamugemereire and accused Mr Lubega of colluding with Ministry of Land officials Robert Opio, the Acting Commissioner for Land Registration, and Sarah Kulata, Interdicted Commissioner, to take their land located on Nakivubo-Allen Road.
A letter signed by Dr Douglas Singiza, the Land Probe Secretary, directed Mr Lubega to appear in person without fail and halted any further construction works on the disputed land.
“You are accordingly directed to halt the said construction and desist from any other actions prejudicial to the commission’s inquiries. You are invited to appear at the commission offices to explain your claim of ownership to the said land on Friday at 8am,” the letter reads.
In a separate letter, the land inquiry also directed the Kampala Capital City Authority (KCCA) Director for Physical Planning, Mr Moses Atwine, to provide a written explanation on whether the directorate cleared all the construction works already undertaken on the land.
The bus operators, in a May 9, 2017 letter before court, accused Mr Lubega of violently evicting lawful occupants on the land and causing destruction of property of the bus operators without compensation.
According to the complaint, at the time of the eviction, the owners were shareholders of UBOI and Horizon Coaches owned by former motor rally driver Charles Muhangi.
In April 2015, the Constitutional Court ordered Mr Lubega to restore the peaceful status quo that existed before the dispute. The court ruled the eviction of Horizon Coaches in March 2014 was unlawful. Last year, the Supreme Court dismissed Businessman Lubega’s appeal challenging the Constitutional Court order for him to vacate the bus park land.
