Kabaziguruka Case: State Challenges Promotion of Two Defendants

The state prosecution in the case where Nakawa MP Hon Michael Kabaziguruka and 23 others are charged with treachery before Makindye General Court Martial has dismissed the recent promotion of UPDF officers on the defense.

In the previous session, troche court heard that Cpl. Richard Odama and Lance Cpl. Godfrey Inyani while in detention had been promoted to Sergeant and Corporal respectively; which  prompted state prosecutor, symptoms Maj. Raphael Mugisha to seek an adjournment to enable him amend the charge sheet.

However this morning Major Mugisha informed court that they after doing some inquiries from the concerned authorities, they found that the promotions never happened.

“My lord I would like to inform this honorable court that none of the accused persons was promoted. As of now investigations in the matter are about to be completed, thus we seek this matter to be adjourned to 6th September for mentioning of the case” submitted Mugisha.

In reply to this, defense counsel Maj Patra Asha objected to this long adjournment and asked court to grant her a shorter adjournment to enable her file in court formal submission from all the accused persons challenging their trial in army court.

The matter has been adjourned to 23rd August for the defense to file their submission on accused persons challenging jurisdiction of court martial.

The defense is also expected to submit on this date the documents concerning the promotion of two UPDF soldiers in detention.
