Kabale Municipal Council has been dragged to the High Court by Wilson Mbabazi, a concerned resident of Kigongi ward in Central Division, over the manner in which the Municipal yard was sold to Cephas Birungyi Kagyenda.
Late last year, the municipality sold its yard on Plot 11-17 along the Kabale – Mbarara road to lawyer Cephas Kagyenda who is also the Kabale district chairperson of the land board at Shs. 1billion.
The has been housing a health centre II, a store and the municipal education offices.
Mbabazi through his lawyers of M/S Bemanyisa & Co. Advocates asked court to annul the land transaction, on grounds that it contravenes the PPDA Act.
Mbabazi says the Municipal leadership never consulted the people on the sale of the yard but the mayor sat in a meeting with his executive and the speaker and passed the sale of public land.
Didas Muhumuza, the Kabale High Court Registrar has since ordered the Kabale Municipal Council to file its defense within 15 days.
Emmanuel Sentaro Byamugisha, the Kabale mayor says he was yet to get the court summons.
The mayor however, insists that the council went through the right channels to sell off the property, which he says needed to be developed as they prepare to become a city.
