High court judge Jane Francis Abodo on Monday heard an application for review, filed by Dr Stella Nyanzi seeking the court’s intervention in the cyber harassment and offensive communication case before Buganda Road court.
In this application, Nyanzi through her lawyers Isaac Ssemakadde and Julius Galisonga, wants High Court to halt the impending judgement at Buganda Road Court.
She accuses this court of denying her rights to a fair trial.
Nyanzi also faults the Magistrate of failing to effectively serve summons to all her 20 defence witnesses and instead shifted the burden to her side.
She had listed President Yoweri Museveni as one of her witnesses but court ruled that with the presidential immunity in the constitution, he cannot appear unless it’s out of his will
She further blamed the trial Magistrate for closing her defense before she could present any witnesses.
Nyanzi through her lawyers, believes Magistrate Kamasanyu is biased and wants High Court to order for a re trial under another Magistrate
In response to these accusations however, the State Prosecutor Timothy Amerit asked court to dismiss this application for review and to order for the file to be referred back to Buganda Road for judgement.
Amerit added that the Magistrate granted Nyanzi a number of opportunities to bring her witnesses but she never utilized them.
The judge has set this Wednesday 31st July to deliver a ruling in this matter
