Wakiso Grade One Magistrates Court has Wednesday permitted State Prosecution to take over the case in which Presidential Hopeful Robert Kyagulanyi Bobi Wine is accused of lying to state authorities about his education.
The case was filed by city lawyer Male Mabirizi who has said in the past that he wants to prevent Bobi Wine from appearing on the ballot in next year’s election.
In the case, Mabirizi had argued that Bobi Wine provided false information to the Electoral Commission which subsequently nominated him for the Kyadondo East parliamentary by-election in 2017.
Following heated exchanges in the court today between Emily Ninsiima from the DPP’s office and Mr Mabirizi, the Magistrates Esther Nyadoi ruled to allow the State to officially take over the matter.
The Magistrate said she was satisfied with the State’s argument that this case was of serious national importance and that it should be handled by government and not a personal.
As such the magistrate ordered Mabirizi to hand over all the evidence he has in this matter to the State.
Lawyer Male Mabirizi had expressed fear in the past that government wants to take over this matter in order to drop it later on.
The matter proceeded in the absence of Bobi Wine, who according to his lawyers Shamim Malende, Wameli Anthony and Abudullah Kwanuka, had not been informed in time.
However, Mabirizi told court that he had personally informed Bobi Wine through a WhatsApp message, which the latter received but never responded to.
Mabirizi as such asked the magistrate to issue an arrest warrant against the Kyadondo East MP.
