High Court’s International Crimes Division has dismissed the charges against former Makerere University Researcher Dr Stella Nyanzi and ordered her immediate release from Luzira Prison.
Dr Nyanzi, who has been in prison since late 2018, was accused of Cyber Harassment and sentenced to 18months in jail last year.
The charges stemmed from Nyanzi’s social media posts on President Yoweri Museveni and his late mother Esteri Kokundeka.
In August last year, Dr Nyanzi appealed against the sentence that was handed to her by the Buganda Road Magistrates Court
In his ruling today, High Court’s Justice Henry Adonyo accused the Buganda Road Magistrates court of failing to provide a fair hearing to the accused, as Nyanzi was not allowed to defend herself.
The judge also faulted he prosecution for failure to provide sufficient evidence; and therefore quashed the conviction and sentence.
However, shortly after her release, Dr Nyanzi was forced into a Prisons van and driven back to Luzira Prison.
Prison officials said she needed to be formerly logged out of the system.
There was commotion at the court as some of her supporters tried to prevent her from being taken back to jail.
