EAC Secretary General Responds to Mabirizi’s Allegations

Amb. Liberat Mifumkeko the Secretary General (Head of the Secretariat) of the East African Community has finally filed his defense in the case in which Ugandan lawyer Hassan Male Mabirizi accuses him of breaching the EAC Emblems Act.

In his response filed to the East African Court of Justice, Mifumkeko owned up to the contents in the press statement issued to all media outlets on 15th September 2020 in which he castigated Mabirizi’s acts and contents on the posters.

He noted however, that the said press statement didn’t in any way prejudice the outcome of the pending judgement in the East African Court of Justice.

In the press release, the EAC Secretary had accused Mabirizi of publishing an advert on various social media platforms in which he used the East African Community emblem and photos of Justices of East African Court of Justice to raise funds for personal purposes

As such, he asked court to dismiss the matter on top of fining the applicant (Mabirizi) not less than one thousand United States dollars.

In his application before EACJ Mabirizi accuses the Secretary General of condemning him without first giving him a chance to free and fair hearing as required to the rules of natural justice.

In his affidavit in support Mabirizi said that the Secretary could have ascertained first whether such purported advert exists, whether he had a right to use them, and if the photographs of judges originated from Mabirizi.
