Buganda Road Magistrates Court has issued witness summons to all 19 people whom former Makerere University Researcher Dr Stella Nyanzi listed as her defence witnesses
Yesterday the case in which Nyanzi is accused of disturbing the peace of President Museveni, came back for hearing but none of the witnesses was in court.
This was the second time that witnesses shunned Dr Nyanzi.
Earlier last week, the first defence witness, Mugisha B Mustapha, a member of the Institute of Forensics and ICT Security, refused to testify in court saying he wasn’t conversant with the matter.
This prompted Counsel Isaac Ssemakadde yesterday to ask court for serious action to be taken against their witnesses for contempt of court.
Among the witnesses summoned to court is the head of the Police’s CID, AIGP Grace Akullo.
The Senior State Attorney Janat Kitimbo asked court to order the defence to close their case by filing their final submissions.
“Court can’t compel somebody who has nothing to add on a case to testify” Janat added.
Ssemakadde pointed out that due to financial constraints they have been able to summon only a few witnesses who have failed to show up in court without any clear explanation
“AIGP Akullo is our star witness because the whole matter is pegged around her ” Ssemakadde added.
Although the defence had asked for issuance of warrant of arrest to the witnesses, court declined to grant this.
The case is expected to resume today
Nyanzi who rejected bail is currently on remand in Luzira Prison pending the hearing of the case.
Prosecution alleges that Nyanzi committed cyber harassment and offensive communication on 18th September 2018 on social media.
