Court Sets Date for Tumukunde Bail Hearing

The head of Criminal Division of High Court, Justice Wilson Kwesiga has April 14th April 2020 as the date at which he will deliver a ruling on the bail application filed by Rtd Lt General Henry Tumukunde who is charged with Treason and unlawful possession of fire arms.

In a notice served to the office of Director of Public Prosecution(DPP) and applicants lawyers of Wameli and company advocates, this matter will not be heard in an open court.

According to the judge, this is in respect with the presidential directives on prevention of Coronavirus which suspended public gatherings for a period of 32 days

The applicant’s lawyers will serve the respondents with all supporting evidence of this application not later than 28th March 2020, while the respondent will file any reply in case of any not later than 3rd April 2020.

Justice Kwesiga also directed that all pre-trial proceedings be transferred from City hall magistrates court to Buganda Road Chief Magistrates court with a view of managing these proceedings through video linked system in line with the directions.”

On Friday last week Tumukunde through his lawyers of Wameli and Company advocates applied for bail before high court on grounds that he is sick, he is a sole bread winner of his family, a Presidential Candidate in consultation period, has fixed place of abode in court’s jurisdiction, offences are bailable, has substantial sureties and he is ready to abide by all bail conditions.

Tumukunde was remanded on Monday last week by City Hall grade one Magistrate Valeria Tumuhimbise on charges of Treason and Unlawful Possession of fire arms.

Prosecution contends that retired Lt Gen Henry Tumukunde on 5th March 2020 at NBS Television in Kampala district during the morning breeze show made utterances to wit if I was Rwanda I would wish to support people who want to cause change aimed at instigating the Republic of Uganda to cause unlawful change of government.

Its further alleged that on 13th March 2020 at Impala Avenue Kololo in Kampala district he was found in possession of an AK 47 and Star Pistol without valid fire arm certificates.
