Court Sets Date for Ruling on Otunnu’s Defamation Case Against Museveni

Buganda Road Court Grade One Magistrate Joan Aciro has set the 25th of April as the date on which she will deliver her ruling on a ‘no case to answer’ in the matter where former UPC Party President, prescription Amb. Olara Otunnu is accused of defaming President Yoweri Kaguta Museveni.

Otunnu’s counsel Asuman Basalirwa had asked the magistrate to dismiss the case saying that the prosecution lacked witnesses.

Ever since the matter was brought to court on August 20th, 2013, prosecution has only produced one witness.

“Your worship we pray for dismissal of this case because in the last court sitting the court issued guidance to the prosecution which it has not considered up to now. There is no evidence on record that any witness was summoned,” he said.

Basalirwa added that its surprising that even the one witness who appeared in court was never called back by the state for cross examination which he says makes his [witness] testimony incomplete.

In reply to defense submissions, the state prosecutor asked the magistrate not to dismiss the matter but instead allow them to have their case closed.

In her ruling the magistrate declared that court has closed the prosecution case after having warned them earlier.

Prosecution alleges that on 16th January 2013 during his weekly news conference at Uganda House in Kampala, Otunu attacked president Museveni’s regime referring to it as one full of political assassinations.
