Court Set To Hear Kutesa Corruption Case

High court in Kampala has set February 25th to start hearing the case filed by Brian Atuheire, who wants a court declaration that Foreign Affairs minister Sam Kutesa is not fit to head the Ministry, owing to corruption allegations against him.

The date is contained in a hearing notice signed on the 8th January 2019 by the Deputy Registrar of the High court.

Among others, Atuheire wants court to declare that Hon Kuteesa is not fit to hold a public office, and also wants government through the office of the Directorate of Public Prosecution(DPP) to commence criminal proceedings against him.

In his affidavit in support of this matter, Atuheire alleges that Kutesa while serving as a foreign Affairs minister in May 2016 received a bribe worth $ 500,000 from Hong Kong Home affairs minister Patrick Ho, contrary to Sec 2 (a) 5 (iii) of the Anti-corruption Act 2009

He adds that Patrick was found guilty after trial by the US District judge in Southern District of New York with one count of conspiring to violate foreign corruption practices Act (FCPA), and one count of conspiring to commit money laundering

Atuhaire says failure of the DPP to take any action against the minster and his continued stay in office contravenes article 83 of the constitution
