The Court of Appeal has set free six former aides of Gen David Sejusa who were sentenced to 15 years in jail by Makindye General Court Martial after being convicted of aiding and abetting the commission of Treachery.
According to a discharge order signed by the Deputy Registrar Court of Appeal and addressed to the Officer in Charge Luzira Upper Prison, the sentence and conviction by the Court Martial have been set aside.
” The conviction of 15 years for the offence of treachery and aiding and abetting commission of treachery is quashed. The respective sentences are set aside,” ordered the appellant court, adding that the appellants should immediately be set free unless they are held on other lawful charges.
The freed convicts are Corporal Nasasira Grace, Corporal Karuhanga Frank, Nayebare James Karuhanga, Nuwagaba Moses, Moses Kakarugahi and Twinamatsiko Abel.
These were on 14th July 2015 convicted of treachery and aiding and abetting of the same and later sentenced to 15 years in jail.
These however, challenged the army court decision before the military court of appeal, which on 7th July 2017, being chaired by Justice Elly Turyamubona dismissed the appeal on grounds that none of the grounds raised by the applicants led to the miscarriage of justice
Through their lawyer David Mushabe, these petitioned the civilian Court of Appeal for the matter to be heard by more than three Justices.
Prosecution had claimed that the six, since May 2013 had engaged in subversive activities when they planned to recruit fellow soldiers from Special Forces command (SFC) with intent to overthrow the government of Uganda.
