Court Orders Taxi Body to Pay Shs. 100M to Good Shed Transporters

Justice (Principle judge) Flavian Zeija has issued an order directing Uganda Taxi Operators to pay a sum of 100 million shillings to Sharif Ahmed Umar and Kaganda Saidat of Good Shed Transporters Park as damages resulting from illegal setting up a taxi park on the land they had hired for other businesses

In June 2010, Good Shed transporters park alongside two other individuals petitioned High Court’s land division challenging UTODA by then of blocking them from setting up a Lorry park at land located along Nsambya-Gaba which they had hired from Rift Valley Railways

They informed court that although they had made an installment on rent and hired contractors to start construction of the park, they were violently attacked by people in UTODA uniforms who had insisted that they should operate a taxi park in  that area.

In his ruling, the judge pointed out that it was wrong for UTODA to attack people contracted to construct a park in the land which they had never expressed interest

“The 2nd defendant failed to show that they had a proprietary interest in the premises since they did not show any documentary evidence to that effect. In fact, they failed to defend the case at all as they failed to adduce evidence.”

Court however, ruled that it’s no longer possible to reinstate them on the said land because this prayer was overtaken by events since UTODA is no longer occupying the said land and secondly Rift Valley Railways is not in charge of that land anymore.
