High Court Deputy Registrar Flavia Nabakooza has issued a temporary injunction restraining Kampala Capital City Authority (KCCA) from continuing with the construction of Bunamwaya – Entebbe road until the main case challenging the process is fully heard and closed off.
“A temporary injunction doth issue restraining the respondent/defendant/her servants, agents or any person claiming under her from developing or carrying out any further road construction or further trespass on land comprised on Kyadondo block 267 plots 195, 196, 7 at Lweza until the final determination of the main suit,” reads part of the order.
In the main suit, Ssenyonjo Rashid Musisi dragged KCCA to court accusing the Authority of encroaching on his land Comprised in Kyadondo on Block 267 plots 195 and 197 at Lweza during the ongoing construction of Bunamwaya- Entebbe road.
He alleges that KCCA constructed a road on the said land without his consent or compensating him.
He adds that KCCA went ahead and brought construction materials on to the said land on top of excavating and ferrying materials like stones from that land without any permission.
Ssenyonjo further pointed out that with the heavy machines being used in the construction of this road, his property has developed cracks and or fissures that have damaged the walls of his structures.
It’s from the above background that the applicant has asked the court to order KCCA to compensate him for the damages, costs of the suit on top of issuing a permanent injunction restraining the respondent and his agents from further trespassing on the said land.
