High Court judge Yasin Nyanzi has this afternoon granted bail to Patrick Agaba aka Pato, a key suspect in the murder of Susan Magara, who has been in Luzira Prison on unrelated kidnap charges.
Pato, who was arrested and extradited from South Africa on charges of murder, was last month charged before Makindye chief magistrates court with the kidnap of another woman Joan Alupo, who he allegedly kidnapped on 1st May 2013 in Muyenga with an intent to procure a ransom of $ 400, 000 from her relatives in exchange for her freedom.
The judge said he released the suspect after considering the fact that the state Prosecutor Joanitah Tumwikirize didn’t object to the bail application and because the sureties presented in court were substantial
The judge also considered the long period Pato has been in jail before committal to High court for trial
Agaba’s biological father Christopher Kasaija and Richard Kagoro Agaba a paternal uncle, who stood him surety were ordered to execute a non cash bond of 20 million shillings while two other sureties were ordered to execute a Shs 25 million non-cash bond
Pato was ordered to report to the Officer in Charge (O.C) Kabalagala Police station every first day of the month starting this weekend
To ensure that he turns up in court for trial, he was ordered to deposit in the Registry the land agreement of his house located in Bukasa under the names of his wife Patra Kugonza as well as his passport
He is also not to travel outside the country without first informing the court Registrar
The matter is at mentioning stage before Makindye Magistrates court as he investigations leading to his committal to High court are still underway
