Buganda Road chief magistrate Joan Aciro has released 5 Uganda Young Democratic (UYD) youths after dismissing the charges of inciting violence which were slapped on them by the State last year, when they made statements intended to incite violence at Parliament.
The five are Bigirwa Moses, Kitonsa Allan, Juma Kayondo, Haruna Nsibuka and Hakim Kizza on 19th September 2016.
These were charged and remanded to Luzira and later released on October 5th last year.
The magistrate decided to throw out the case after prosecution failed to produce witnesses even when they were given the last adjournment in the last court sitting.
“The state had asked for the last adjournment but even today they have not presented any witness and neither have they amended the charge sheet to prosecute the accused,” pointed out Aciro
The magistrate added that ever since a warrant of arrest was issued against Kitonsa and Kayondo, the state has not explained why they have not been arrested.
“Basing on the powers granted to this court under section 119 of the Magistrates Court Act (MCA) I dismiss this case and the warrant of arrest against the two accused persons is terminated,” ruled Aciro.
