High Court judge Anglin Flavia Senoga has convicted Robert Mutebi and Geoffrey Lubwama for the murder of 25-year-old Rodney Gatare, who worked as a systems accountant at the Ministry of Finance.
The two are said to have murdered Gatare on 31st December 2014 at Serena Hotel in Kampala, before robbing his Blackberry phone and a wallet.
The judge in her ruling, based on evidence in the confession statement which had a detailed account of how the deceased was killed.
The judge pointed out that while the two initially denied this statement, during the trial within a trial, court was convinced that Police underwent all the required procedures before obtaining their statements.
She added that the Doctors who examined the accused didn’t find any sign of torture on their bodies.
“The statement was voluntarily made and court is entitled to take it into consideration under Section 25 of the Evidence Act ” ruled the judge
She added that this confession statement placed the accused at the scene and none of them in their defence denied attacking the deceased
Court therefore overruled the defence’s submission that there was lack of corroborative evidence by independent witnesses by the prosecution witnesses in order for court to convict them.
The judge concurred with the Assessor’s opinion who had asked court to convict the two on charges of aggravated robbery and murder.
The case was adjourned to 22nd July for sentencing.
