The Speaker of Parliament, Rebecca Kadaga on Tuesday officially ruled that the four backbench members of the Commission should be elected.
ChimpReports has since December 4th reported on the plans to restructure the appointment of MPs intocoveted positions in Parliament, mainly the Commissioners, who are the highest decision makers in the affairs of the august house.
The Commission composed of the Speaker, the Leader of Government Business or a nominee, the Leader of the Opposition, the Minister responsible for finance and four backbench Members of Parliament, is the administrative organ of Parliament.
The Administration of Parliament Act 2, as amended in 2006, provides for the establishment of the Commission.
“The Commission shall be composed of the Speaker, the Leader of Government Business or his or her nominee, the Leader of the Opposition or his or her nominee, the Minister responsible for finance and four members of Parliament one of whom shall come from the opposition and none of whom shall be a Minister.”
Apparently the appointment of Commissioners by NRM CEC (3 positions) and FDC CEC (1 position) has been in contravention of law by the implication of Kadaga’s ruling.
The Administration of Parliament’s Act 2 (b) says: “Nomination of the candidates for election to the Commission of the four members of Parliament referred to in subsection (2) shall be made by the Government and opposition sides.”
Kadaga, conscious of the mood in the house and the ramifications of the move, carefully read both the articles in the Constitution and the Rules of Procedures of Parliament in making her official communication.
“I have studied the provisions of the Constitution, the Administration of Parliament Act and our Rules of Procedures and I have found out that section 2(2) of the Administration of Parliament Act is clear that there is supposed to be a nomination of members for election of the four members of the Commission,” said Kadaga.
The matter has been referred to the Committee of Rules to study and come up with a harmonized way implementing the new interpretation of the law.
Both the Government Chief Whip, Ruth Nankabirwa and Opposition Chief Whip, Ssemujju Ibrahim Nganda tried to put a fight but Kadaga over ruled them.
The NRM CEC chaired by President Yoweri Museveni on November 30th 2018 reappointed the 3 Commissioners of Parliament including: Peter Ogwang of Usuk, Kakumiro woman MP, Robinah Nabanja and Workers representative Arinaitwe Rwakajara.
FDC President Patrick Amuriat appointed Buhweju MP Francis Mwijukye to replace Dokolo woman MP, Cecilia Ogwal.
The new appointment and reappointment have by implication been annulled and the designates should get ready to subject themselves for election.
