The General Court Martial sitting in Makindye has released on bail, former IGP Gen Edward Kale Kayihura.
Gen Kayihura who has been in detention since June at the Makindye Military Police headquarters, is facing charges of failure to protect war materials and abetting kidnap.
Unable to hide his joy, Kayihura’s face suddenly brimmed as his relatives and supporters erupted in ululation when the Court Martial Chairman Gen Andrew Gutti made the pronouncement.
Gen Kayihura was granted a Shs 10million non cash bail, whereas his sureties, who include Maj Gen Sam Kavuma, Maj Gen James Mugira Hon Rose Tumusiime were placed on a Sh 5 Million bond, also non cash.
Among the bail conditions, Gen Kayihura was directed to stay in the districts of Kampala and Wakiso and not to travel abroad unless he has permission from the same court.
The former Police boss is also to report back to the court every first Monday of the month, and any other occastions as directed by court.
In his bail application, Kayihura had told that he needed to travel to Nairobi for treatment.
He also noted that he is of old age and that bail is his constitutional right.
Gen Gutti in his ruling, stated that while Kayihura’s offences are grave in nature and attract the maximum death sentence, the court could not disregard these factors and also the fact that he is a first time offender.
