Vision Group has fired local daily Bukedde paper’s photo editor for publishing of a picture that was taken by Daily Monitor photographer Alex Esagala.
Esagala has since demanded the company to pay him Shs 400m in compensation for the award winning photo.
Last week Esagala through his lawyers of Kaggwa and Kaggwa Advocates, wrote a notice of intention to sue to Vision Group Printing and Publishing Chief Executive Officer, Robert Kabushenga over a Makerere University riot picture that appeared on Bukedde paper without the consent of the former.
“On the 25th day of November, 2019 a photograph that was taken by our client appeared on Bukedde newspapers,” said part of the letter.
Esagala’s lawyers indicated that the publishing of the picture taken April 16th 2018, which even won the Uganda Press Photo Award, without the consent of the owner amounted to a copyright infringement.
“Your actions of publishing the picture without our client’s consent amounts to a copyright infringement contrary to the Copyright and Neighboring Rights Act, 2006,” noted the letter.
According to sources at the Industrial Area based daily, Kabushenga ordered an investigation into the circumstances under which a picture from Daily Monitor ended up on Bukedde without meeting the known requirements.
On Thursday the management decided to take action against Herbert Lumansi, the photo editor who was on duty when the publication happened. Mr. Lumansi has been shown the exit.
Vision Group has been asked to pay Shs 400m to Esagala in damages or face civil suit.
“In the foregoing (of civil suit) we request for usage fees and damage of Ug.shs. 400,000,000/= due to the great risk our client takes while taking the said pictures and skill while executing the same,” said Kaggwa Kaggwa Advocates.
