Buganda road grade one magistrate Stella Amabirisi has referred back to High court a case in which a YMCA student Brian Isiko is accused of sending love messages to Kabarole Woman MP Sylvia Rwabwogo, for interpretation
This followed State Prosecutor Miriam Njuki’s request to the trial magistrate for permission to bring in more witnesses than those who had testified earlier in the case which was referred back for retrial.
However, the defense counsel Ramathan Waiswa objected to this request saying that it’s unlawful to call in other witnesses than those who had testified earlier.
This prompted the trial magistrate to refer back the matter to High court to pronounce itself on whether against the rules of procedure to add more testimony in this matter.
Late this year High court judge Jane Francis Abodo quashed both the 2 year sentence and conviction of Brian Isiko as had been decided by Buganda road grade one magistrate and ordered for a fresh trial before another magistrate.
In October 2018 Isiko was charged afresh before grade one magistrate Stella Amabirisi and later released on a cash bail of one million shillings.
Isiko is indicted with two counts of computer misuse and cyber harassment of which he pleaded not guilty.
Prosecution accuses Isiko of disturbing the peace of the legislator when he allegedly sent endless love messages to her and also dedicating to her lovely songs from international superstars such as Don Williams, Kenny Rodgers, P-Square, among others.
