Bishop David Kiganda of Christianity Focus Center in Kisenyi has dragged to court city businessman John Katonya for allegedly grabbing part of his land and constructing buildings on it.
Appearing before Buganda Road grade one Magistrate Stella Amabirisi, Kiganda informed court that although various groups of surveyors have made findings that the land in question belongs to him, Katonya has stubbornly declined to vacate
“I pray that this honourable court orders Katonya to return my land by demolishing all the buildings he constructed on it,” he said.
The Pastor informed court that the fight for this land has been ongoing since 2016 and that despite the intervention of various authorities halting further development on the said land, the accused has never respected them.
“All reports by our surveyors and all independent surveyors have indicated that all the buildings belonging to Mr Katonya were constructed with part of them encroaching on our land,” he said,
Kiganda said that LC1 Chairman of Kiganda zone, OC CID Old Kampala Police, Kampala Metropolitan Police leadership and the Commission of Land Inquiry have all intervened in this matter with numerous recommendations which the accused has failed to respect.
“The independent Government surveyor from Ministry of Lands who was recommended to us by working with surveyors from both sides made a finding that there was some encroachment done on Christianity Focus Church land but the report was never respected.”
The pastor also submitted in court various survey reports which were conducted on the land as well as photographs indicating the level of encroachment.
The case was adjourned to 14th March for further hearing.
Katonya was granted bail on charges of impersonation, uttering fake documents, forgery and criminal trespass.
