Kipoi’s lawyer Mike Okechi of Kakooza Fred and Co. Advocates said his client had acute abdominal ailments which needed urgent medical attention.

The lawyer further submitted that the MP had family responsibilities, adding, as a legislator, he needed time to represent his constituents in Manafwa district.

Police with its sister security agencies in December 2012 arrested Kipoi during a meeting with some Ugandan security officers and Congolese rebel officers.

Police publicist Judith Nabakooba said then Nsubuga was cornered in Matimuku Guest House, Njala Village, Fort Portal, Kabarole district during the meeting.


“For, some time, now, the Police with its sister security agencies have been closely monitoring subversive activities of Hon. Kipoi Tony in and out of the country,” said Nabakooba.

“In particular, he has been recruiting personnel from our security services as well as Congolese rebels belong to a Congolese rebel group called COGAI, based in areas around Bunia, Ituri, and Democratic Republic of Congo.”

Kipoi has since been held and charged with kidnap, treason and concealment of treason.

Justice Mukasa, however, blasted State Attorneys’ claims that all witnesses from Uganda and Congo had not yet been interviewed close to two months after the arrest.

“In a case of such gravity, it is mandatory for police to have carried out all investigations before effecting the arrest,” said Mukasa.

Kipoi’s sureties included EAC representative Fred Mukasa Mbidde, his brother Richard Mutambi, a resident of Bukoto, his sister Judith Babirye, a teacher in Makindye, and a one Robert Kitabi.

This is not the first time politicians in Uganda are being held for reportedly oiling connections with subversive elements.

Betty Nambooze, Medard Ssegona, Reagan Okumu, Col Kizza Besigye among others have in the past been thrown behind bars for reportedly recruiting rebels to overthrow the government of President Yoweri Museveni.

But State has never successfully secured conviction for politicians named in treason cases.

According to Nabakooba, MP Nsubuga had promised to support the rebel groups with fire arms.

The netted Ugandan army officers were reportedly providing crucial military intelligence to the Congo rebels to facilitate the project.

“We also have information, that Hon. Kipoi Tonny has foreign sponsors who at this point it would not be wise to disclose” observed the Police spokesperson.

She added: “It should be noted that this is not the first time, that Hon. Kipoi is involved in criminal activities. In fact he is currently facing charges of narcotic drug and a fine of Shs1, 000,000, which he paid.

“As Police with its sister security agencies continue to apprehend the collaborators of Hon. Kipoi Tony we wish to assure the general public and the country at lager of safety and security as you go about your programs of the festive season.”
