Makindye Chief Magistrate Esther Nambayo in February convicted Kalungi of unlawfully causing Nebanda’s death by possessing cocaine with the lawmaker abused before her demise.
Justice Lameck Mukasa on Friday agreed with the defence team that Kalungi was wrongfully convicted of manslaughter because he did not have the competence of a medical doctor to save Nebanda’s life after the MP took an overdose of cocaine.
Court was also convinced that Kalungi did whatever he could to save Nebanda’s life by contacting two doctors to treat the lawmaker and also driving her to the nearest health centre.
Kalungi’s lawyers successfully convinced High Court that the lower court did not properly evaluate the evidence hence arriving at a wrong conclusion.
Kalungi’s mother, Saudah Mbabazi broke into tears of joy upon hearing the ruling exonerating her son from any wrongdoing.
“This judgment is a gift from Allah during this holy month of Ramadhan,” said Mbabazi.
The mother together with a few family members held a brief special prayer session thanking the God for the positive judgment.
Nebanda’s death sparked off a huge public outcry, with members of the public urging a deeper investigation into the circumstances under which the legislator passed away.
Politicians who accused government of having a hand in Nebanda’s death were arrested.
Government maintains it did not kill Nebanda as alleged by some politicians.
